Why you should make a Will

  • Posted

We spend our lives working to provide for ourselves, children and our loved ones and having a Will is arguably one of the most important things we can put in place.

A Will lets you leave clear instructions about how your estate is to be distributed and by whom. Without a Will your estate is subject to the intestacy rules and may not go to the people you would have chosen.

If you have a property, savings, or possessions you need to consider making a Will.

Making a Will ensures:

  • your assets are distributed according to your wishes
  • you can protect your assets for your family and future generations
  • you are providing for a partner, as without a Will they may not receive anything that belongs to you as they have no right to inherit
  • you are avoiding expensive legal costs, stress and worry for your loved ones
  • you appoint people you want and trust (Executors) to manage the legal, practical and administrative steps needed after your death
  • you can choose guardians to look after your children
  • you can make provisions for any pets you may have
  • you don’t pay more Inheritance Tax than you need to, as a well drafted Will ensures this

What will happen if you do not have a Will?

  • If you pass away without a Will (intestate), the Intestacy Rules will determine who will inherit your estate, regardless of your relationship, so your assets may not be distributed as you wish
  • Your spouse may not automatically inherit all your assets – what they will receive depends on the size of your estate and other living family members
  • Unmarried or co-habiting partners are not entitled to anything under the Intestacy Rules
