What is a Lasting Power of Attorney (LPA)?

An LPA is a legal document that allows someone aged over 18 to choose someone as an attorney and who they want to make decisions on their behalf when they are unable, through physical and/or mental incapacity, to make the decision themselves. This may be because of infirmity, dementia, learning disabilities, mental health problems, stroke or head injuries.

An LPA is created in advance of someone losing mental capacity and it must be registered with the Office of the Public Guardian before it can be used.

There are two types of LPA:

  • Property and financial affairs (allowing an attorney to make decisions about paying bills, dealing with the bank, collecting benefits, selling your house, etc.)
  • Health and welfare (allowing decisions on treatment, care, medication, where you live, etc.)

The benefits of making a Lasting Power of Attorney

An LPA allows you to plan in advance:

  • the decisions you want to be made on your behalf if or when you lose capacity to make them yourself
  • the people you want as attorney to make these decisions
  • how you want the attorney to make these decisions.

If you have not completed an LPA, other people may need to apply to the Court of Protection to make any decision on your behalf. This can be costly, lengthy, time consuming, demanding and stressful for your relatives and carers.

Costs of making a Lasting Power of Attorney

The cost of making a Property & Financial LPA* OR Health and Welfare LPA* is £395.00 plus VAT which is a total of £474.00 plus a Court fee of £82.00.

The cost of making both a Property & Financial LPA* AND Health and Welfare LPA* is £700.00 plus VAT which is a total of £840.00 plus a Court fee of £164.00 (£82.00 per LPA).
